Terms of Service

If you do not agree to these Terms, do not use Horecas. If you are using the platform on behalf of a business, you represent that you have authority to bind that business to these Terms.

You must be at least 18 years old and able to form a binding contract to register a Venue Account. Guests using a venue's ordering, reservation, or shop pages must provide accurate contact details and comply with the venue's policies as well as these Terms.

You are responsible for safeguarding login credentials and for all activity under your account, including actions taken by team members you invite. You must provide accurate registration information and keep it up to date. We may suspend accounts that appear fraudulent, abusive, or in violation of these Terms.

Guest-facing features (menus, online ordering, reservations, retail shop, reviews, and promotions) are provided by Horecas on behalf of the venue you interact with. The venue is responsible for menu accuracy, pricing, fulfilment, and compliance with local consumer and food-safety laws. Disputes about an order, reservation, or purchase are primarily between you and the venue; we may assist with technical support where appropriate.

Paid plans, trials, and add-ons are billed as described at checkout or in your plan selection. Subscriptions renew automatically unless cancelled before the renewal date. Fees are non-refundable except where required by law or explicitly stated in writing. We may change pricing with reasonable notice to active subscribers.

Payment processing is handled by Stripe. By subscribing, you also agree to Stripe's applicable terms for payment methods you provide.

You agree not to:

• Use the platform for unlawful, misleading, or harmful purposes.
• Send spam or marketing messages without valid consent.
• Attempt to access accounts or data you are not authorised to use.
• Interfere with or disrupt the platform, including by automated scraping or overload.
• Upload malware, infringing content, or material that violates third-party rights.
• Misrepresent your identity or affiliation with a venue or brand.

Venues retain ownership of content they upload (menus, images, branding, campaigns) and of guest data generated through their pages. You grant Horecas a limited licence to host, display, process, and transmit that content solely to operate and improve the platform. Venues are responsible for having a lawful basis to collect and use guest data and for honouring marketing opt-outs.

Horecas integrates with third-party providers such as Stripe (payments), Meta/WhatsApp Cloud API (messaging), email delivery services, analytics, and live-chat tools. Your use of those services may be subject to their separate terms and privacy policies. We are not responsible for third-party services outside our reasonable control.

Horecas and its licensors own the platform, software, documentation, and branding, except for content supplied by venues. You may not copy, modify, reverse engineer, or resell the platform except as expressly permitted in writing.

The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by law, Horecas and its affiliates, officers, and employees will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total liability for any claim arising from these Terms or your use of the platform is limited to the greater of (a) amounts you paid to Horecas in the twelve months before the claim, or (b) USD 100.

You agree to indemnify and hold harmless Horecas from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the platform, your breach of these Terms, or your violation of applicable law.

You may stop using Horecas at any time. We may suspend or terminate access if you breach these Terms, fail to pay fees, or if continued provision poses risk to the platform or other users. Upon termination, your right to use the platform ends; provisions that by nature should survive (including payment obligations, disclaimers, and limitations of liability) will remain in effect.

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles. Disputes will be subject to the exclusive jurisdiction of the courts of the UAE, unless mandatory local law requires otherwise.

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above and, where appropriate, communicated to Venue Account holders. Continued use after changes take effect constitutes acceptance of the updated Terms.
